Netlion s.r.o., Company No. 05999235, registered office at Vladislavova 85, Vysoké Mýto-Město, 566 01 Vysoké Mýto, Czech Republic, registered in the Commercial Register kept by the Regional Court in Hradec Králové, file no. C 39080

Version 1.0, effective from 2026-08-23

This is a translation. The Czech version prevails in the event of any discrepancy, subject to Article 15.3.

Article 1 – Introductory provisions and definitions

1.1These terms of service (the "Terms") govern the rights and obligations of the parties in the provision of the QueryBeam service available at querybeam.eu to a consumer, that is a natural person who enters into the contract outside the scope of their business activity or the independent exercise of their profession (Section 419 of Act No. 89/2012 Coll., the Civil Code, as amended, the "Civil Code").

1.2For the purposes of the Terms:

a)the Operator means Netlion s.r.o., Company No. 05999235, with its registered office at Vladislavova 85, Vysoké Mýto-Město, 566 01 Vysoké Mýto;

b)the User means the consumer who has entered into the Contract with the Operator under Article 3;

c)the Called Person means the natural person called under the Service; the Called Person may be the User or another natural person who has given consent under Article 4.2;

d)the Service means the QueryBeam service defined in Article 2;

e)Credit means the prepaid sum from which calls made are paid under Article 5;

f)the Contract means the contract for the provision of the Service entered into under Article 3, of which the Terms form an integral part.

1.3The Terms do not apply to partner accounts. Where the contract is entered into by a legal entity or a trader, in particular a provider of health services, a provider of social services or a company, the Terms do not apply to that contractual relationship, not even by analogy; a partner agreement concluded in written form applies instead and is not published.

1.4Rights and obligations not expressly governed by the Terms are governed by the Civil Code and by Act No. 634/1992 Coll., on consumer protection, as amended.

Article 2 – Subject matter of the Contract and definition of the Service

2.1The Operator undertakes to provide the User with the Service, consisting in the automated collection of answers by telephone call. A voice assistant places a call according to the schedule set by the User, asks the questions entered by the User, and records the answers together with a transcript of the call.

2.2The Service serves to collect answers. It does not make a diagnosis, does not assess health status, does not recommend a course of treatment, and issues no alert on the basis of the content of an answer. Assessment of the content of an answer belongs solely to a human being.

2.3The Service is not a medical device within the meaning of Article 2(1) of Regulation (EU) 2017/745 of the European Parliament and of the Council and must not be used as a medical device.

2.4The Service is not intended for urgent or acute situations. A call is scheduled in advance, need not be completed, and is not monitored in real time. Should the health of the Called Person deteriorate, the appropriate course is to contact a provider of health services or the emergency number.

Article 3 – Formation of the Contract

3.1The Contract is formed by the User's registration and the Operator's confirmation of the order. Before the order is submitted, the subject matter of the order and its price are displayed to the User; the User may correct the details entered until the order is submitted (Section 1826(3) of the Civil Code).

3.2The User is obliged to provide accurate information and to protect their login credentials. Should the User suspect unauthorised access to their account, they shall notify the Operator without undue delay at support@querybeam.eu.

3.3The Contract is concluded in the Czech or the English language. The Operator retains the wording of the concluded Contract and shall make it available to the User on request.

Article 4 – Conditions for calling and the consent of the Called Person

4.1The Service shall not place a call to a telephone number that has not been confirmed. A message containing a verification code is sent to the telephone number entered; the telephone number is unlocked only upon entry of that code.

4.2By confirming the code, the Called Person grants consent for the Service to call them and to record the call. The wording to which the Called Person consents is contained in Consent to Telephone Questioning.

4.3The User undertakes:

a)to enter solely the telephone number of a person who knows of the calls and consents to them;

b)not to circumvent confirmation of the code, in particular not to enter, in place of the Called Person, a code delivered to them;

c)to stop the calls where the Called Person ceases to want them; this is without prejudice to the right of the Called Person to withdraw consent themselves at any time, during a call or at info@querybeam.eu;

d)not to use the Service for marketing, for the dissemination of commercial communications, or for research;

e)to formulate questions so that they are not misleading and do not seek data beyond the purpose pursued;

f)not to use the Service for urgent situations, nor to present it as such to the Called Person.

4.4Where the Called Person is a person other than the User, the User acknowledges that the recorded answers shall be made available to the User. The Called Person is informed of this fact in the wording referred to in Article 4.2.

4.5Breach of the obligations under Article 4.3(a), (b) or (d) constitutes a material breach of the Contract.

Article 5 – Price and payment terms

5.1Calls are paid from Credit prepaid by the User. Prices are stated in the price list at querybeam.eu/cenik inclusive of value added tax. The price in force at the moment the order is submitted applies.

5.2A call accepted by the Called Person is charged, from the moment of acceptance. Calls not accepted, calls to a busy telephone number and unsuccessful calls are not charged.

5.3Credit does not lapse by the passage of time.

5.4The Operator shall refund unused Credit at the User's request, both on termination of the Contract and at any time during its term. The request is submitted at info@querybeam.eu. The Operator shall return the funds within 14 days of receipt of the request, by the same means by which it received them, unless the parties agree otherwise.

5.5What is returned is the funds paid by the User, less the sum corresponding to the calls made. The application displays the sum to be returned.

5.6Credit provided to the User in excess of the sum paid (the "Bonus Volume") is provided for topping up Credit. Where the Operator returns the sum paid under Article 5.4, the Bonus Volume lapses with it; the whole top-up including the Bonus Volume is therefore deducted from the Credit. Credit provided without payment, in particular trial Credit, is not affected.

5.7The Operator shall send the User proof of payment by electronic mail.

Article 6 – Withdrawal from the Contract within 14 days

6.1The User is entitled to withdraw from a Contract concluded by means of distance communication within 14 days of its conclusion, without giving a reason (Section 1829(1) of the Civil Code). Withdrawal is notified at info@querybeam.eu by an unequivocal statement; use of the model form is not a condition.

6.2Where the User requests that provision of the Service begin before expiry of the period under Article 6.1, the right to withdraw from the Contract does not thereby lapse. Should the User then withdraw from the Contract, they shall pay the Operator a proportionate part of the price corresponding to the calls made (Section 1834 of the Civil Code); the remaining Credit is returned under Article 5.

6.3The Operator shall return the funds within 14 days of withdrawal from the Contract.

Article 7 – Availability of the Service, support and rights from defective performance

7.1The Operator shall use its efforts to ensure uninterrupted availability of the Service, save for planned maintenance, which it announces in advance.

7.2The Service depends on telephone networks and on the services of third persons. The Operator is not liable for the Called Person not accepting a call, ending a call, or answering unintelligibly; these circumstances are not a defect in the Service.

7.3Support is provided at support@querybeam.eu on business days from 09:00 to 17:00.

7.4The User exercises rights from defective performance at info@querybeam.eu. The Operator shall confirm receipt of the complaint and settle it within 30 days at the latest; should it fail to settle it within that period, the User is entitled to withdraw from the Contract. Rights from defective performance are governed by Section 1914 et seq. of the Civil Code; where the Service does not correspond to what was agreed, the User has the right to have the defect removed and, where that is not possible, to a reasonable discount from the price or to withdrawal from the Contract.

Article 8 – The recorded answer and its verification

8.1The answer of the Called Person is recorded in three layers, being:

a)the value, meaning the datum extracted from the answer in the required data type;

b)the source quotation, meaning the verbatim wording of the statement of the Called Person including its position in the call;

c)the call record, meaning the recording and transcript of the whole call.

8.2Extraction of the value from free speech is performed by an automated system and is not error-free. For that reason the source quotation from which the value arose is retained with every value.

8.3The Operator recommends that the User compare the recorded value with the source quotation before making a significant decision on its basis. Where the source quotation does not correspond to the value, or the source quotation is absent, the appropriate course is to verify the content against the call record or directly with the Called Person.

8.4The call record is available to the User for 12 months from the day the call was made; after expiry of that period it is deleted. The source quotation remains with the value for the whole period of its retention. The User is entitled to download the call record within the period under the first sentence.

8.5Where a dispute or complaint arises concerning a call, the Operator shall retain the record of it for the duration of the matter, beyond the period under Article 8.4. The request is submitted at info@querybeam.eu before expiry of that period; after its expiry the call record is irreversibly deleted and cannot be retained retrospectively.

Article 9 – Liability

9.1The Operator is liable for harm caused by breach of its obligations to the extent laid down by law.

9.2No provision of the Terms limits the statutory rights of the User. A limitation of liability does not apply and cannot be agreed in respect of harm to the natural rights of a person, harm caused intentionally or by gross negligence (Section 2898 of the Civil Code), or rights under Regulation (EU) 2016/679 of the European Parliament and of the Council.

9.3The Operator is not liable for decisions which the User makes on the basis of data obtained through the Service, nor for the accuracy and completeness of the statement of the Called Person; for that reason the source quotation under Article 8.2 is retained with every value.

Article 10 – Artificial intelligence

10.1The Service uses an artificial intelligence system. The Called Person is informed at the beginning of every call that they are speaking to an automated assistant, as required by Article 50 of Regulation (EU) 2024/1689 of the European Parliament and of the Council. That information cannot be suppressed and the User is not entitled to present the assistant as a human being.

10.2Speech recognition and extraction of answers are not error-free; for that reason the source quotation under Article 8.2 is retained.

Article 11 – Processing of personal data

11.1For calling ordered by the User as a consumer, the Operator is the controller of the personal data.

11.2The legal basis for processing the data of the Called Person is their consent under Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council and, for health data, under Article 9(2)(a) of the same Regulation, granted by the procedure under Article 4.2.

11.3The scope of processing, the retention periods, the recipients of the data and the rights of the data subject are set out in the Personal Data Processing Policy and in the list of sub-processors.

Article 12 – Duration and termination of the Contract

12.1The Contract is concluded for an indefinite period.

12.2The User is entitled to terminate the Contract at any time, with no notice period and without penalty; unused Credit is returned under Article 5.4.

12.3The Operator is entitled to terminate the Contract on one month's notice. The Operator is further entitled to restrict or suspend provision of the Service should the User materially breach the Terms or should reasonable suspicion of misuse of the Service arise; it shall inform the User of the reason.

12.4After the Contract ends, personal data is deleted under the Personal Data Processing Policy.

Article 13 – Changes to the Terms

13.1The Operator is entitled to change the Terms. It shall notify the User of a change by electronic mail at least 30 days before the day it takes effect.

13.2Should the User not agree with a change, they are entitled to terminate the Contract before the day the change takes effect, without penalty and with the return of unused Credit.

Article 14 – Dispute resolution

14.1Should a dispute arise between the parties, the User shall contact info@querybeam.eu.

14.2Should no agreement be reached, the User is entitled to turn to a body for out-of-court resolution of consumer disputes. In the Czech Republic that body is the Czech Trade Inspection Authority, with its registered office at Štěpánská 44, 110 00 Prague 1, coi.cz (Section 20d et seq. of Act No. 634/1992 Coll., on consumer protection). Should the User be domiciled in another Member State, they shall turn to the competent body in the State of their domicile; the European Consumer Centre likewise provides assistance.

14.3The right of the User to turn to a court is not affected by the procedure under Article 14.2.

Article 15 – Final provisions

15.1Rights and obligations under the Contract are governed by the law of the Czech Republic. By the choice of law the User is not deprived of the protection afforded by those provisions of the law of the State of their habitual residence from which it is not possible to derogate by contract (Article 6 of Regulation (EC) No 593/2008 of the European Parliament and of the Council, Rome I).

15.2The User is entitled to bring a claim before the court of their domicile; the Operator is entitled to bring a claim against the User solely before the court of the User's domicile (Article 18 of Regulation (EU) No 1215/2012 of the European Parliament and of the Council, Brussels I bis).

15.3The Terms are issued in the Czech and the English language. In the event of any discrepancy between the versions, the Czech version prevails; this does not apply where such a determination would worsen the position of the User compared with the version in which they entered into the Contract.

15.4Should any provision of the Terms be invalid or ineffective, this does not affect the validity and effectiveness of the remaining provisions.
